Welcome to Home! These Terms and Conditions ("Terms") govern your use of the Practice with Home mobile application and website (collectively, the "Service") operated by Practice with Home, Inc. ("Home," "we," "us," or "our").

By accessing or using our Service, you agree to be bound by these Terms. If you disagree with any part of these Terms, then you may not access the Service.

1. Description of Service

Home is an AI-powered meditation platform that creates personalized meditation experiences. Access to Home requires an active subscription after a limited free trial period. Our Service includes:

  • AI-generated conversational chat that adapts to you over time

  • AI-generated meditation content tailored to your inputs, emotional state, and personal context

  • Voice synthesis technology for guided meditation audio playback

  • A persistent memory system that remembers details you share across sessions to deepen personalization

  • Personalized recommendations based on your preferences, experience level, and usage patterns

  • Subscription-based access to premium features and unlimited sessions

  • Optional session feedback tools to help improve the app

Home is designed to support your wellness journey through technology, but it is not a substitute for professional medical or mental health care.

2. Eligibility and Account Registration

Age Requirements

  • You must be at least 13 years old to use our Service

  • Users between 13-17 must have parental consent to create an account

  • Parents and guardians of users ages 13-17 should review our Privacy Policy, particularly regarding the types of personal and wellness-related data the App collects

  • We may request age verification at any time

Account Responsibilities

  • Provide accurate and complete information during registration

  • Maintain the security of your account credentials

  • Notify us immediately of any unauthorized access to your account

  • You are responsible for all activities that occur under your account

3. Acceptable Use

You May

  • Use the Service for personal, non-commercial meditation and wellness purposes

  • Share your meditation experiences with others (but not redistribute our content)

  • Provide feedback and suggestions to improve the Service

You May Not

  • Use the Service for any illegal or unauthorized purpose

  • Attempt to reverse engineer, decompile, modify, or create derivative works of our AI technology, voice synthesis, or any other proprietary systems

  • Share your account credentials with others

  • Upload harmful, offensive, or inappropriate content in your chat inputs

  • Use the Service in any way that could damage, disable, or impair our systems

  • Attempt to gain unauthorized access to any part of the Service

  • Attempt to extract, scrape, or systematically collect data from the Service

  • Use the Service to generate content for purposes other than personal meditation practice

  • Attempt to manipulate, circumvent, or exploit our AI systems through engineered prompts, adversarial inputs, or other techniques designed to bypass content guidelines, extract system instructions, generate harmful content, or cause the AI to behave outside its intended purpose

4. AI-Generated Content and Disclaimers

Content Generation

  • Our AI creates meditation content and conversational responses based on your inputs, conversation history, stored memory context, and our training prompts

  • While we strive for accuracy and appropriateness, AI-generated content may occasionally be imperfect, inaccurate, or unsuitable

  • We do not guarantee that AI-generated meditations will meet your specific needs or expectations

  • AI responses are not professional advice of any kind

Memory and Personalization

  • Our AI analyzes your conversations to extract and store personal facts you share (such as your name, occupation, relationships, or current stressors) to personalize future interactions

  • You can request deletion of your memory data at any time through your account settings or by contacting us

  • The AI uses your memory profile and conversation history to inform its responses, but it may occasionally recall details inaccurately or make incorrect inferences

  • We do not guarantee the accuracy of AI-generated summaries, fact extractions, or personalizations

Medical Disclaimer

IMPORTANT: Home is designed for wellness and relaxation purposes only. Our Service:

  • Is NOT medical treatment or a substitute for professional healthcare

  • Is NOT therapy or a replacement for mental health treatment

  • Should NOT be used as the sole treatment for any medical or psychological condition

  • May NOT be suitable for individuals with certain medical conditions

  • Does NOT provide clinical assessments, diagnoses, or treatment plans

The AI's references to your emotional state, stress, or wellness are conversational in nature and should not be interpreted as clinical evaluations.

If you have mental health concerns, medical conditions, or are in crisis, please consult with qualified healthcare professionals immediately.

5. Intellectual Property

Our Content

  • Home owns all rights to our AI technology, app design, branding, and proprietary content

  • Our meditation prompts, voice configurations, AI system instructions, and app features are protected by copyright and other intellectual property laws

  • You may not reproduce, distribute, or commercially use our proprietary content without written permission

Your Content

  • You retain ownership of any personal reflections, chat messages, or inputs you provide to the Service

  • By using our Service, you grant us a limited license to process your inputs to generate personalized meditation content and to extract and store personal facts for the purpose of improving your experience

  • We do not claim ownership of your personal meditation experiences, insights, or the personal information you share

Generated Meditations

  • Meditations created specifically for you through our AI may be used for your personal practice

  • You may not redistribute, sell, or commercially exploit AI-generated meditation content

  • We do not train our own AI models on your personal inputs or identifiable session content. Our AI processing is performed by third-party providers (see our Privacy Policy for details) whose API terms prohibit using your data for model training.

6. Subscription Terms and Billing

Payment Processing

  • All payments are processed through Apple's App Store

  • We do not directly handle payment information or billing

  • Subscription terms and billing cycles are managed through your Apple ID account

Subscription Plans

  • Trial Access: We may offer a free trial period to new users. After the trial, continued use requires a paid subscription. We do not offer a freemium tier or ongoing free use of the Service.

  • Premium Subscription: Unlimited sessions and personalized memory.

  • Pricing and available features may change over time. We will provide reasonable advance notice of any changes that affect your subscription.

  • We reserve the right to test different pricing or promotional offers as part of product development.

Cancellation and Refunds

  • You may cancel your subscription at any time through your Apple ID account settings

  • Cancellation takes effect at the end of your current billing period

  • Refund requests must be made through Apple's App Store refund process

  • We do not process direct refunds as we do not handle payment processing

Auto-Renewal

  • Subscriptions automatically renew unless cancelled before the renewal date

  • You can manage auto-renewal settings in your Apple ID account

  • We will provide reasonable notice of any price changes before renewal

7. Privacy and Data Protection

Your privacy is important to us. Our collection, use, and protection of your personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference.

Key points:

  • We collect your name, email, onboarding preferences, session feedback, and usage data

  • Our AI analyzes your conversations to extract and permanently store personal facts for personalization across sessions

  • Your chat messages, conversation history, and memory context are sent to third-party AI providers (currently Anthropic and OpenAI) for processing

  • Meditation scripts containing personalized content are sent to ElevenLabs for voice synthesis

  • We use Amplitude for product analytics and Firebase Crashlytics for crash reporting

  • RevenueCat manages subscription verification

  • We do not sell your personal data to third parties

  • You can delete your account and all associated data at any time through the App's account settings

Data Breach Notification

In the event of a confirmed security breach that affects your personal information, we will notify affected users within 30 days of confirming the breach via email or in-app notification. Our notice will describe the nature of the breach, the types of data involved, and the steps we are taking in response. This commitment is in addition to any notification obligations required by applicable law, which may require shorter timelines in certain jurisdictions.

8. Account Deletion

You may delete your account at any time through the App's account settings. Upon account deletion:

  • Your user profile, memory data, extracted facts, session history, and saved meditations will be permanently removed from our systems

  • Your subscription (if active) must be cancelled separately through your Apple ID account settings to stop future billing

  • Data already processed by third-party providers is subject to those providers' retention policies

  • Some data may be retained as required by law or for legitimate business purposes (such as fraud prevention or legal compliance), but will not be used for personalization

9. Service Availability and Modifications

Service Availability

  • We strive to provide reliable Service but cannot guarantee 100% uptime

  • Scheduled maintenance will be announced when possible

  • We are not liable for service interruptions due to technical issues, third-party providers, or circumstances beyond our control

  • Our AI features depend on third-party API availability (Anthropic, OpenAI, ElevenLabs). Disruptions to these services may temporarily affect functionality.

Modifications to Service

  • We may update, modify, or discontinue features of the Service with reasonable notice

  • This includes changes to AI providers, voice synthesis services, or personalization features

  • Significant changes that affect core functionality will be communicated via email or in-app notifications

  • We reserve the right to modify these Terms with 30 days' notice for material changes

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

  • Total Liability Cap: Our total liability to you for any claims related to the Service will not exceed the amount you paid for the Service in the 12 months preceding the claim.

  • No Consequential Damages: We are not liable for indirect, incidental, special, consequential, or punitive damages, including but not limited to damages arising from reliance on AI-generated content, loss of data, or interruption of meditation practice.

  • Service Limitations: We do not warrant that the Service will be error-free, secure, or meet your specific requirements. While we strive to provide a high-quality experience, we make no guarantees regarding uptime, content accuracy, memory recall accuracy, or uninterrupted access.

  • AI Limitations: AI-generated content may contain errors, inappropriate suggestions, or inaccurate personalizations. We are not liable for any harm resulting from reliance on AI-generated meditation content or conversational responses.

  • Third-Party Services: We are not responsible for the performance, availability, or data practices of third-party services we rely on, including but not limited to Apple, Anthropic, OpenAI, ElevenLabs, Google Firebase, Amplitude, and RevenueCat.

Wellness App Specific Disclaimers

  • We make no medical claims about the effectiveness of meditation or our specific approach

  • Individual results may vary and depend on many factors beyond our control

  • Our AI-generated content is for general wellness purposes and may not be suitable for everyone

  • The memory and personalization features are designed to improve your experience, not to provide clinical assessments or professional guidance

11. Indemnification

You agree to indemnify and hold harmless Home, its officers, directors, employees, and agents from any claims, damages, or expenses (including reasonable attorneys' fees) arising from:

  • Your use of the Service in violation of these Terms

  • Your violation of any rights of another person or entity

  • Any content you submit that infringes on intellectual property rights

  • Your breach of any representation or warranty in these Terms

12. Termination

Your Right to Terminate

  • You may stop using the Service and delete your account at any time through the App's account settings

  • You may also request account deletion by contacting hello@practicewithhome.com

  • Upon termination, your right to use the Service ceases immediately

Our Right to Terminate

We may suspend or terminate your account if you:

  • Violate these Terms or our Privacy Policy

  • Use the Service in a way that could harm other users or our systems

  • Provide false information during registration

  • Engage in fraudulent or illegal activities

  • Attempt to abuse, exploit, or circumvent the AI systems or subscription mechanisms

Effect of Termination

  • Terminated accounts lose access to all Service features

  • Upon termination, your data will be handled as described in Section 8 (Account Deletion) and our Privacy Policy

  • Subscription fees are not refunded upon termination for cause

  • Provisions of these Terms that should survive termination will remain in effect (including Sections 5, 10, 11, 12, and 13)

13. Dispute Resolution

Governing Law

These Terms are governed by the laws of Delaware, United States, without regard to conflict of law principles.

Informal Resolution

Before filing any formal legal action, we encourage you to contact us at hello@practicewithhome.com to resolve disputes informally.

Binding Arbitration

Any disputes that cannot be resolved informally will be settled through binding arbitration in accordance with the rules of the American Arbitration Association, conducted in Delaware.

Class Action Waiver

You agree that any arbitration will be conducted on an individual basis and not as part of a class action or collective proceeding.

Small Claims Court

Notwithstanding the above, either party may bring an individual action in small claims court in the party's county of residence or in Delaware, provided the claim falls within the court's jurisdictional limits.

Opt-Out Right

You may opt out of the arbitration and class action waiver provisions by sending written notice to hello@practicewithhome.com with the subject line "Arbitration Opt-Out" within 30 days of first agreeing to these Terms. Your notice must include your name, email address associated with your account, and a clear statement that you wish to opt out. If you opt out, all other provisions of these Terms remain in effect. Opting out will not affect your ability to use the Service.

14. Changes to These Terms

We may revise these Terms from time to time. If we make material changes, we will notify you via email, in-app message, or on our website at least 30 days before the changes take effect. By continuing to use the Service after the updated Terms are posted, you agree to the revised Terms.

15. General Provisions

Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Home regarding the Service.

Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will remain in full force and effect.

Assignment

You may not assign or transfer your rights under these Terms. We may assign our rights and obligations under these Terms without restriction.

No Waiver

Our failure to enforce any provision of these Terms does not constitute a waiver of that provision or any other provision.
