Practice with Home, Inc. Terms and Conditions

Welcome to Home. These Terms of Service ("Terms") govern your use of the Practice with Home mobile application and the practicewithhome.com website (together, the "Service"), operated by Practice with Home, Inc. ("Home," "we," "us," or "our").

By creating an account or using the Service, you agree to these Terms and to our Privacy Policy, which is part of these Terms. If you don't agree, please don't use the Service.

We've tried to write this in plain language. Where the law needs us to be precise, we are — but we want you to actually understand what you're agreeing to.

1. What Home Is

Home is an AI-powered meditation and wellbeing app that creates a personalized practice for you. Using Home requires an active subscription after a free trial. The Service includes:

  • A conversational AI chat that listens to what you bring, adapts to you over time, and may proactively offer you a practice based on what you share.

  • AI-generated personalized meditations created for you in the moment, shaped by your inputs, your check-in, and your saved context — delivered as text-to-speech audio in a synthetic voice. Because your meditation is personalized, the audio may include your name and the things you've described.

  • A "check-in" hub where you tell Home how you're doing — for example your energy and how your body feels — so the practice can meet you where you are.

  • Voice input. You can speak instead of type. When you do, your spoken audio is captured by your microphone and converted to text (speech-to-text) so the AI can respond. See Section 4 for how voice is handled.

  • A persistent memory that remembers details across sessions to deepen personalization — including personal facts the AI extracts from what you share, recent session summaries, patterns in how you practice, a calibration of how much guidance you tend to want, and how you felt after a session.

  • Subscription-based access to unlimited sessions and personalized features.

  • Optional feedback tools to help us improve the app.

Home is designed to support your wellbeing through technology. It is not a substitute for professional medical or mental-health care (see Section 4).

We may add, change, or remove features over time. If we make a significant change to what the Service does or how it handles your information, we'll let you know (see Section 11).

2. Who Can Use Home (Eligibility & Minors)

Age.

  • You must be at least 13 years old to use the Service.

  • If you are 13–17, you may use the Service only with the consent and involvement of a parent or legal guardian, who agrees to these Terms on your behalf.

  • The Service is not intended for children under 13, and we do not knowingly collect personal information from them. If we learn that someone under 13 has created an account, we will delete it.

Age requirement. By using Home, you represent that you are at least 13 years old, and that if you are 13–17 a parent or guardian has reviewed and agreed to these Terms and our Privacy Policy on your behalf. We do not collect a date of birth or operate a separate age-verification screen; this age requirement is a condition of using the Service.

For parents and guardians. Because Home invites people to share how they're feeling, please review our Privacy Policy with your teen — especially the parts about wellbeing-related and voice data — before consenting.

Account responsibilities. You agree to:

  • provide accurate information when you sign in;

  • keep your account credentials secure;

  • tell us promptly about any unauthorized use of your account; and

  • take responsibility for activity under your account.

3. You're Talking with AI

Home's chat and meditations are generated by artificial intelligence, not by a human therapist, coach, or counselor. When you use the chat, you are interacting with an AI system. It can be warm and responsive, but it does not understand you the way a person does, and it can be wrong.

Home is a meditation and wellbeing practice — it is not therapy, counseling, or medical care. Please keep this in mind, especially in moments when you're struggling.

Home may also point you to these resources if it senses you're struggling, but it cannot detect every situation and is not an emergency service — please reach out to the resources above directly.

4. AI Content, Memory, Voice & Disclaimers

How the AI works

  • Home's AI creates meditations and chat responses based on your inputs, your conversation, your saved memory, your check-in, and our internal prompts.

  • AI-generated content can be imperfect, inaccurate, or not quite right for you. We don't guarantee it will meet your needs or expectations.

  • AI responses are not professional advice of any kind.

Memory, inference, and personalization

  • Home doesn't just store what you type. Its AI analyzes and makes inferences from your conversations and check-ins to build a personal profile that shapes future sessions. This includes:

    • personal facts it extracts from what you share (for example your name, relationships, routines, or things you're carrying) — kept as a limited set of remembered facts;

    • summaries of recent sessions and patterns in how and when you practice;

    • a calibration of how much guidance you tend to respond to; and

    • how you reported feeling after a session.

  • Some of what the AI infers may touch on emotional, mental-wellbeing, or health-relatedthemes. These inferences are the AI's best guess from limited information — they can be incomplete or wrong, and they are not clinical assessments, diagnoses, or evaluations of you.

  • You can view and request deletion of your memory data through your account settings or by contacting us. We don't guarantee the accuracy of any extracted fact, summary, inference, or personalization.

Voice input

  • When you choose to speak instead of type, your device's microphone records your voice and converts it to text so the AI can respond.

  • To do this, your spoken audio may be processed by Apple's speech-recognition service as well as on your device.

  • Your voice is transcribed, not used to identify you. Home does not create a voiceprint, does not use your voice for biometric identification, and does not attempt to recognize who you are from how your voice sounds. We're interested in the words, not the voice.

  • The resulting transcript is treated like any other thing you share — it may inform your memory and personalization as described above.

Medical disclaimer

IMPORTANT: Home is for wellbeing and relaxation only. The Service:

  • is NOT medical treatment or a substitute for professional healthcare;

  • is NOT therapy or a replacement for mental-health treatment;

  • should NOT be used as the sole treatment for any medical or psychological condition;

  • may NOT be suitable for everyone, including people with certain conditions; and

  • does NOT provide clinical assessments, diagnoses, or treatment plans.

Anything the AI says about your emotional state, stress, or wellbeing is conversational, not clinical. If you have mental-health concerns or a medical condition, please consult a qualified professional. If you're in crisis, see the resources in Section 3.

5. Acceptable Use

You may:

  • use the Service for personal, non-commercial meditation and wellbeing;

  • share your own experiences with others (but not redistribute our content); and

  • send us feedback and suggestions.

You may not:

  • use the Service for any illegal or unauthorized purpose;

  • reverse engineer, decompile, modify, or create derivative works of our AI, voice technology, or other proprietary systems;

  • share your account credentials;

  • submit harmful, abusive, or unlawful content;

  • damage, disable, overload, or impair the Service;

  • gain or attempt to gain unauthorized access to any part of the Service;

  • scrape or systematically extract data from the Service;

  • use the Service to generate content for anything other than your own personal practice; or

  • manipulate or exploit the AI — through engineered prompts, adversarial inputs, or similar techniques — to bypass safeguards, extract system instructions, generate harmful content, or push the AI outside its intended purpose.

6. Your Content & Our Content

What you own

You keep ownership of the things you bring to Home — your reflections, chat messages, spoken inputs, and the personal information you share. Home doesn't claim to own your experiences, insights, or personal information.

The license you give us

So that Home can actually work, you grant us a worldwide, non-exclusive, royalty-free license to do the following with the content you provide, solely to operate and improve the Service for you:

  • process your text and voice inputs to power the chat, generate your meditations, and respond to you;

  • transcribe your voice recordings to text, and process and store those transcripts as part of your inputs and memory;

  • extract, infer, and store personal facts and summaries from your inputs to personalize future sessions, as described in Section 4;

  • generate, store, and play back personalized meditation audio for you — including audio that may contain your name or details you've shared — and retain it for your practice until you delete it (see Section 8); and

  • transmit the relevant content to the third-party providers that help deliver the Service (our sub-processors — currently Anthropic, OpenAI, Apple's speech-recognition service, ElevenLabs, Google Firebase, Amplitude, and RevenueCat), as described in our Privacy Policy.

This license exists only to run the Service and ends when you delete the relevant content or your account, except for the limited residual processing described in Section 8.

What we own

  • Home owns its AI technology, app design, brand, prompts, voice configurations, system instructions, and features, which are protected by intellectual-property laws.

  • You may not reproduce, distribute, or commercially use our proprietary content without written permission.

Your generated meditations

  • Meditations created for you are for your personal practice.

  • You may not redistribute, sell, or commercially exploit AI-generated meditation content.

  • We do not train our own AI models on your personal inputs or identifiable session content. The AI processing that powers Home is performed by third-party providers (see our Privacy Policy), and we rely on those providers' API and account terms — which prohibit using your content to train their models — including the zero-retention terms we have in place with our voice provider.

7. Subscriptions & Billing

Payment.

  • Payments are processed through Apple's App Store using your Apple ID. We don't directly handle or store your payment information. Subscription verification is managed through our provider, RevenueCat.

Plans.

  • Free trial: new users may get a 7-day free trial. After the trial, continued use requires a paid subscription. There is no ongoing free tier. (We may offer limited promotional free sessions or codes from time to time.)

  • Subscription: unlimited sessions and personalized memory, offered on monthly and annual plans. Current prices are shown in the App before you subscribe.

  • Founder pricing: some early users hold special founder pricing, which we honor as described at the time of purchase.

  • Pricing and features may change over time. We'll give reasonable advance notice of changes that affect your subscription, and we may test different pricing or promotional offers.

Cancellation & refunds.

  • Cancel anytime in your Apple ID settings. Cancellation takes effect at the end of the current billing period.

  • Refunds are handled by Apple through the App Store refund process; we don't process direct refunds.

Auto-renewal.

  • Subscriptions auto-renew unless you cancel before the renewal date. Manage auto-renewal in your Apple ID settings. We'll give reasonable notice before any price change takes effect.

8. Account Deletion & Data Retention

You can delete your account anytime in the app's account settings, or by emailing hello@practicewithhome.com.

When you delete your account, we permanently delete the personal data we hold about you, including:

  • your profile;

  • your memory profile and all extracted facts;

  • your session history, saved meditations and their feedback; and

  • the meditation audio files stored for you (including any that contain your name).

When you delete your account, we also automatically request deletion of your data from our analytics provider (Amplitude); that deletion completes within 30 days.

A few things to know:

  • Your subscription is separate. Deleting your account does not cancel your Apple subscription — you must cancel that in your Apple ID settings to stop future billing.

  • Third-party AI processing. Content already transmitted to our AI sub-processors for processing is handled under their terms. We use providers whose terms prohibit training on your content; any residual copies they hold are subject to their retention policies, not ours.

  • Legal holds and abuse prevention. We may retain limited information where the law requires it (for example for tax, fraud-prevention, or legal-compliance reasons), and a minimal promotional-code redemption record (an internal identifier tied to a code) to prevent code abuse. We won't use any of it for personalization.

Retention while your account is active. We keep your data while your account is active so the Service can remember you. Some memory is capped automatically (for example, we keep a limited number of extracted facts and recent session summaries, dropping the oldest first). Saved meditations and their audio are kept until you delete them or your account.

9. Service Availability & Changes

  • We work to keep the Service reliable but can't guarantee 100% uptime.

  • We're not liable for interruptions caused by technical issues, third-party providers, or events beyond our control.

  • Home's AI features depend on third-party APIs (including Anthropic, OpenAI, Apple, and ElevenLabs); disruptions to those services may temporarily affect functionality.

  • We may update, modify, or discontinue features with reasonable notice, including changing AI or voice providers. We'll communicate significant changes to core functionality (see Section 11).

10. Disclaimers & Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

  • Liability cap. Our total liability for claims related to the Service won't exceed what you paid us in the 12 months before the claim.

  • No consequential damages. We're not liable for indirect, incidental, special, consequential, or punitive damages — including those arising from reliance on AI-generated content, loss of data, or interruption of your practice.

  • Service "as is." We don't warrant that the Service will be error-free, secure, or fit for your specific needs, or guarantee uptime, content accuracy, or memory-recall accuracy.

  • AI limitations. AI-generated content may contain errors, inappropriate suggestions, or inaccurate inferences. We're not liable for harm resulting from reliance on it.

  • Third-party services. We're not responsible for the performance or data practices of third parties we rely on, including Apple, Anthropic, OpenAI, ElevenLabs, Google Firebase, Amplitude, and RevenueCat.

  • Wellbeing app. We make no medical claims about meditation or our approach; individual results vary; our content is for general wellbeing and may not suit everyone; and memory/personalization features are designed to improve your experience, not to provide clinical guidance.

Your local rights. Nothing in these Terms limits rights that can't be limited under the law where you live. Some jurisdictions don't allow certain limitations, so some of the above may not apply to you.

11. Changes to These Terms

We may revise these Terms. If we make material changes — including significantly expanding what data we collect or how the AI processes it — we'll notify you by email, in-app message, or on our website, and update the date above. For material changes, we may ask you to accept the updated Terms in the app; continuing to use the Service after we provide notice means you accept the updated Terms.

12. Indemnification

To the extent permitted by law, you agree to indemnify and hold harmless Home and its officers, directors, employees, and agents from claims, damages, and reasonable expenses (including attorneys' fees) arising from: your use of the Service in violation of these Terms; your violation of someone else's rights; content you submit that infringes intellectual-property rights; or your breach of any representation or warranty in these Terms.

13. Termination

By you. Stop using the Service and delete your account anytime in account settings, or by emailing hello@practicewithhome.com. On termination, your right to use the Service ends.

By us. We may suspend or terminate your account if you violate these Terms or our Privacy Policy, act in ways that could harm other users or our systems, provide false information, engage in fraud or illegal activity, or attempt to abuse or circumvent the AI or subscription mechanisms.

Effect. Terminated accounts lose access to the Service. Your data is handled as described in Section 8 and our Privacy Policy. Subscription fees aren't refunded on termination for cause.

14. Apple App Store (Licensed Application End User License)

These Terms are between you and Homenot Apple. Apple is not responsible for the Service or its content. The following apply to your use of the Home app obtained through Apple's App Store:

  • License scope. Your license to use the app is a non-transferable license to use it on any Apple-branded device you own or control, as permitted by the App Store Terms of Service.

  • Maintenance and support. Home — not Apple — is solely responsible for any maintenance and support for the app. Apple has no obligation to provide any maintenance or support.

  • Warranty. Apple has no warranty obligation for the app. To the extent any warranty isn't effectively disclaimed, if the app fails to conform to an applicable warranty, you may notify Apple, and Apple may refund the purchase price (if any); beyond that, Apple has no warranty obligation, and any other claims are Home's responsibility.

  • Product and IP claims. Home, not Apple, is responsible for addressing any claims relating to the app — including product-liability claims, claims that the app fails to meet a legal requirement, and consumer-protection claims. Home, not Apple, is responsible for investigating and resolving any third-party claim that the app infringes intellectual-property rights.

  • Legal compliance. You represent that you are not located in a US-embargoed country or on a US restricted-parties list, as required by Apple's terms.

  • Third-party beneficiary. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.

15. Dispute Resolution

Governing law. These Terms are governed by the laws of the State of Delaware, USA, without regard to conflict-of-law principles, except where the law of your home jurisdiction must apply (see "Consumers outside the US" below).

Informal resolution. Before filing anything formal, please contact us at hello@practicewithhome.com so we can try to resolve it.

Binding arbitration. Disputes that can't be resolved informally will be settled by binding arbitration under the rules of the American Arbitration Association, conducted in Delaware.

Class-action waiver. Arbitration will be on an individual basis only, not as a class or collective action.

Small claims. Either of us may still bring an individual claim in small-claims court in our county of residence or in Delaware, if it qualifies.

Opt-out. You can opt out of the arbitration and class-waiver provisions by emailing hello@practicewithhome.com with the subject line "Arbitration Opt-Out" within 30 days of first agreeing to these Terms, including your name, the email on your account, and a clear statement that you wish to opt out. Opting out doesn't affect any other provision or your ability to use the Service.

Consumers outside the US. Nothing here takes away mandatory rights you have as a consumer under the laws of your home country. If you live in the EEA, the UK, or another place whose laws give you the right to bring claims in your local courts or that limit pre-dispute arbitration or class-action waivers, those rights are not waived, the arbitration, class-waiver, and Delaware-forum provisions above do not apply to you to the extent they conflict with those mandatory rights, and you keep the right to bring proceedings in your home courts under your local law.

16. General

  • Entire agreement. These Terms and our Privacy Policy are the entire agreement between you and Home about the Service.

  • Severability. If any provision is unenforceable, the rest stays in effect.

  • Assignment. You may not assign your rights under these Terms. We may assign ours, for example in a merger or acquisition.

  • No waiver. If we don't enforce a provision, that's not a waiver of it.

  • Survival. Provisions that by their nature should survive termination will — including Sections 4 (AI/medical disclaimers), 6 (Your Content & Our Content), 7 (Subscriptions & Billing, for amounts owed), 8 (Account Deletion & Data Retention), 10 (Disclaimers & Limitation of Liability), 12 (Indemnification), 14 (Apple), and 15 (Dispute Resolution), and the incorporated Privacy Policy.

These Terms are meant to be fair and transparent — protecting your rights and ours. We believe legal terms should be clear, not complicated.
